Terms
These terms cover TrailWise, a free web app operated by Actual IT (Actual Training Pty Ltd, ABN 60 626 629 454), Brisbane, Queensland. They are not legal advice. If you use the app, that is how you accept them.
The service is free
TrailWise is free. We do not charge a subscription for planning a trip, saving it, or sharing a read-only link. We can change, pause or withdraw the app, or any part of it, because it is offered without a fee. We will not invent a charge for something you have already saved without saying so first.
Outdoor safety
Camping and four-wheel driving in Australia can injure or kill people. Remote country has poor phone coverage, long distances between fuel and water, and weather and track conditions that change in a day. TrailWise is a planning aid. It is not your only map, not a permit, and not a substitute for a capable vehicle, recovery gear, water, and a way to get help that works without this website.
You are responsible for deciding whether a trip is safe for you and the people with you. Before you leave, check:
- Current road, park and track closures with the relevant authority.
- Weather, fire danger, and tide or river levels where they matter.
- Permits, station access and camping rules for each night.
- That your vehicle, fuel, water and recovery gear match the country.
- That someone off the trip knows where you are going and when you are due.
Do not follow a plan into country you are not equipped for because the app drew a line there. If a direction conflicts with a sign, a ranger, or conditions you can see, ignore the app.
Condition reports are not guarantees
Ratings, photos and condition reports are posted by other users. A report that says a track is "good" or a campsite is open is that person's opinion at the time they wrote it. It is not a guarantee, not an inspection, and not advice from Actual IT. Conditions change. Reports can be wrong, out of date, or posted by someone who was mistaken. Treat them as a tip, then check a current official source.
The same limit applies to place names, track lines and campsites derived from OpenStreetMap, to fuel prices, and to road-hazard feeds. They can be missing or stale. Mapbox directions assume a road network that may not match an unsealed track.
Your account and your posts
You are responsible for the activity on your account and for keeping the password to yourself. Do not post anything unlawful, anything that identifies a private person who has not agreed to it, or a report you know is false. We can remove a post or close an account that breaks these terms.
You keep ownership of the text and photos you submit. You give Actual IT permission to store them and show them inside TrailWise for as long as the post stays up. That permission is only so the app can display what you posted. It is not a sale of your photos.
Acceptable use
Do not misuse the service. That includes trying to break into another account, scraping the site so heavily that it stops working for other people, or presenting TrailWise output as an official road closure.
Liability
To the extent permitted by the Australian Consumer Law, TrailWise is provided as-is, and Actual Training Pty Ltd is not liable for loss or damage that comes from relying on a plan, a map, a fuel price, a road-hazard feed, or a user-generated condition report. Nothing in these terms excludes a consumer guarantee or other right that the Australian Consumer Law says cannot be excluded. If the law does allow a limit, our liability for a free service is limited to resupplying the service or paying the cost of having it supplied again.
Law
These terms are governed by the laws of Queensland, Australia. Courts in Brisbane are the intended venue.
